Examine the const. role of Gover. when a sitting CM proceeds for treatment of his prolonge illness.

In the Indian system of government, the Governor is the head of the executive branch in each state, and is appointed by the President of India. The Chief Minister is the head of the government of a state, and is elected by the members of the state legislative assembly.


According to Article 164 of the Constitution of India, if the Chief Minister of a state is unable to discharge the duties of his or her office due to prolonged illness, the Governor may ask the Deputy Chief Minister or any other member of the council of ministers to perform the duties of the Chief Minister until the Chief Minister is able to resume his or her duties.


If the Chief Minister is unable to discharge the duties of his or her office for an extended period of time, the Governor may also recommend to the President that the Chief Minister's office be declared vacant, and that a new Chief Minister be appointed.


Additionally, Article 356 of the Constitution empowers the President to impose President's rule in a state in certain circumstances, including if the Governor of the state reports to the President that the situation has arisen in which the government of the state cannot be carried on in accordance with the provisions of the Constitution.


President's rule is a temporary measure, during which the President assumes direct control of the state's administration, and the Governor acts as the President's representative in the state.
